Since 1st October 2008, Landlords have to meet certain obligations set out by the Government to provide a Landlords Energy Performance Certificate. This must happen before a building is put on the market the landlord and any other third parties involved with the advertisement must ensure that a Landlord EPC has been commissioned before they can market a property for sale or rent. Failure to do so may result in a hefty fine being levied by trading standards.

Did you know that since early 2013 all sales or lettings advertisements for Commercial Properties must illustrate the Landlords EPC rating of the property being advertised within the advertisement.
It is also a requirement for landlords with a commercial property over 500m2 that are frequently visited by the public to display the valid EPC in a prominent place clearly visible to members of the public and where one has previously been produced for the sale, construction or renting out of the property.

Future Commercial Landlord energy performance certificate risk issue…

From 2018 any property being sold or rented out by a Landlord must have an Energy Performance rating higher than “E” i.e between A to E. Therefore, if your Commercial property is one of the ‘one in five’ Commercial properties in the UK with an EPC rating of “E” or below it would be advisable to start thinking about improving the property’s energy efficiency as soon as possible. There are a number of payment mechanism options available such as ‘Energy Performance Contracts’ and the new ‘Green Deal’ payment mechanism which was launched in October 2012 by the UK Government.
